Statement on Challenge to New York Broadband Law .

A coalition of broadband associations today filed suit in federal court seeking an injunction against New York State Budget Bill S2506-C regulating the rate of broadband service in the state of New York. The law is scheduled to go into effect no later than June 15, 2021. The complaint is available here.

“While well-intended, this bill is preempted by federal law and ignores the $50 monthly broadband discount recently enacted by Congress, as well as the many unprecedented commitments, donations and accommodations that broadband providers have made for low-income consumers since the pandemic began. We urge state policymakers to coordinate with their Federal counterparts, and with the broadband industry, to better serve the needs of New Yorkers.”
